This agreement outlines the terms governing your use of our website and the digital photographs we provide for online purposes. By engaging our services, you agree to adhere to these terms, which should be reviewed thoroughly prior to any dissemination or use of the photographs. This document constitutes a binding contract between you, the “Client,” and Picture This Property, LLC, doing business as Picture This Property. Your use of Picture This Property services indicates your acceptance of these terms. If you disagree with these terms, please refrain from using our website and services.

Photographic Usage Rights

The Client is granted an exclusive license to utilize the photographs solely for MLS listings and subsequent marketing activities. These images may be employed in promoting the Client’s brand, real estate agency, brokerage, or team.

Restrictions on Usage

The Client is prohibited from using the photographs for widespread advertising in print media without obtaining consent and/or providing appropriate credit as determined by Picture This Property. Redistribution or sale of the images to third parties, such as home stagers, interior designers, builders, or contractors, is forbidden. Clients are also barred from claiming copyright of the images. Inquiries from third parties interested in the images’ rights should be directed to hello@picturethisproperty.com.

All real estate and interior photographs are the exclusive property of Picture This Property. The content of this website, including graphics, design, and overall appearance, is owned by Picture This Property and protected by United States copyright laws. All images displayed here are copyrighted under United States law. Reproduction, storage, or transmission in any form of any image on this website, partially or in full, is strictly prohibited without explicit written permission.

Photo Archive Duration

Photographs taken by Picture This Property will be stored and accessible for a period of SIX MONTHS from the date of production.

Acquisition and Usage of Photographs

Purchased photographs cannot be reproduced, displayed, transmitted, or otherwise exploited in any form, including digital or print reproduction, publication, or any display, without prior written consent from Picture This Property. The photographs are intended for the Client’s use during the listing period and subsequent marketing by the Real Estate Agent and their Company. The photographs must not be used in a way that implies an endorsement or affiliation with any product, person, or entity not related to the Client. Additionally, photographs may be submitted for virtual staging via a third party.

Disclaimers

The photographs are provided “as is”, with all implied warranties disclaimed, including, but not limited to, warranties of title, non-infringement, merchantability, and fitness for a particular purpose. Floor plan illustrations are approximations and are provided for convenience only with the seller’s consent. Measurements are approximate and not guaranteed to be accurate or to scale. Agents/Homeowners/Buyers should verify measurements independently.

Picture This Property endeavors to comply with privacy and publicity rights laws but does not guarantee the accuracy, reliability, or legality of the photographs or floor plans. If an individual’s photograph appears on this site without their consent and they wish for it to be removed, they should contact us at hello@picturethisproperty.com. Additionally, Picture This Property does not warrant the functionality of this website, its error-free nature, or that the server hosting the website is free of viruses or other harmful elements. Use of this website is at the user’s own risk.

Picture This Property, its owners, employees, subsidiaries, affiliates, and representatives will not be liable for any damages, including but not limited to lost business or profits, data loss, misuse, direct, indirect, incidental, consequential, compensatory, exemplary, special, or punitive damages arising from breach of contract, negligence, or otherwise, even if advised of the possibility of such damages.

The maximum liability for any photograph or product sold or purchased shall not exceed its purchase price. Unauthorized use of a photograph or product will result in the user being held responsible for any claims against such use.

Indemnification and Termination Policy

If the Client uses the photographs in an unauthorized manner, or infringes upon intellectual property rights relating to the photographs or this website, the Client agrees to indemnify and hold Picture This Property, its subsidiaries, affiliates, licensors, and representatives, harmless against any losses, costs, or damages incurred due to unauthorized use of the photographs or breach of this agreement.

Other Terms

This agreement is governed by the laws of the State of Texas, disregarding its conflict of laws principles. Picture This Property reserves the right to modify this website, this agreement, and any information herein at any time without notice. These Terms of Use represent the entire agreement between the Client and Picture This Property regarding the use of the website and services. A failure by Picture This Property to enforce any right or provision in these Terms of Use does not waive that or any other right or provision. Should any part of these Terms of Use
